The permit holder shall adhere to all the conditions listed in Chapter 215 Streets and Sidewalks, Article IV – Sidewalk Cafés and Street Events, in the Code of the Borough of State College. This permit is valid for one year from the date of issuance.
Applicant will indemnify the Borough, its elected officials, officers and employees, from all claims, demands and liabilities for injuries to person or property arising from or in any manner connected with the operation of a sidewalk café or street event, including but not limited to accidents, damages, liens, damages, fines or penalties whatsoever nature, nature or kind, in any way resulting from any act or omission by me with respect to the applicant’s use occupancy possession of use for same sidewalk café, or from any act or omission of the applicant, its directors, officers, employees, contractors, successors, assigns. The indemnification applies whether such injuries, losses, claims, costs, expenses, damages, fines, penalties occur on the sidewalk café/street event area or on other areas adjacent thereto including but not limited to sidewalks, streets, alleys, buildings, structures, improvements, fixtures, signs, awnings, canopies, trees, poles, wires, pipes, conduits, sewers, drains, water lines, gas lines, electric lines, telephone lines, cable television lines, fiber optic cables, traffic signals, street lights, parking meters, fire hydrants, mailboxes, benches, trash receptacles, planters, bicycle racks, newspaper vending machines, bus shelters, fences, walls, retaining walls, steps, ramps, driveways, curbs, gutters, manholes, catch basins, storm water management facilities, landscaping, irrigation systems, public utilities, private utilities, public property, private property, real estate, personal property, tangible property, intangible property.
Applicant will pay all costs, expenses, attorney’s fees incurred by Borough prosecution, defense, suit, action, proceeding, application, alleged breach, undertaking applicant terms permit prior written approval required by law indemnify Borough including costs legal fees incurred enforcing obligations Applicant Indemnification Agreement.
Applicant shall bear, pay, discharge when same become due payable all judgments, lawful claims, demands arising out operation sidewalk café street event officers, directors, agents, servants, employees, personnel, contractors, successors, assigns, invitees, licensees, clients, visitors, customers provide sidewalk café/street event adequate lighting, insurance coverage, damage fixture, machinery, apparatus, appliances, equipment used connection therewith protect indemnify save harmless Borough loss damage expense occasioned misuse alcohol.
The annual fee for issuance permit open sidewalk café without alcohol is $100.00.
The annual fee for issuance permit open sidewalk café with alcohol is $50.00.
